Minganie sans uranium contre le bâillon pour le projet de loi 14

Côte-Nord, 7 décembre 2011. Minganie sans uranium dénonce le désir du gouvernement Charest à imposer un bâillon pour faire passer la Loi 14. Il y a bien sûr des avancés dans ce projet de loi mais il demeure très incomplet. Aucune mention d’un moratoire sur l’uranium n’y est incluse, ce qui est inacceptable compte tenu du manque flagrant d’acceptabilité sociale pour cette filière.

Le projet de loi 14 est imprécis à plusieurs égards. La question de l’acceptabilité sociale est à éclaircir, la définition des zones non municipalisées n’y est pas, aucune mention des résidus radioactifs suite à l’extraction d’uranium, et bien sûr la question des redevances qui demeure entière.

Soulignons que déjà plus de 300 municipalités au Québec ont voté des résolutions contre l’exploration et l’exploitation de l’uranium sur leur territoire. En Minganie ce sont 8 municipalités sur 8 qui ont voté une telle résolution. La MRC de Minganie a récemment voté une résolution dans le même sens. À Sept-Iles, un sondage Léger et Léger a démontré que 87 % des citoyens demandaient un moratoire sur l'uranium.

Comment le gouvernement Charest peut-il prétendre que le projet de loi 14 répond au principe de « l’acceptabilité sociale », alors que la grande majorité des communautés directement touchées, sinon la totalité, s’opposent aux mines d’uranium et à ses résidus radioactifs ? Écoutera-t-il enfin la population qui demande un moratoire sur les mines d’uranium ? Ce n’est qu’une question de temps avant que cet enjeu ternisse sérieusement l’image qu’il cherche à donner au Plan Nord.

Nous tenons d’ailleurs à remercier notre député, Mme Loraine Richard, pour sa dénonciation du Plan Nord. La population de la Côte-Nord est derrière elle. Ceux et celles qui disent qu’elle bloque le Plan Mord et qu’elle n’est pas à l’écoute sont tout-à-fait dans l’erreur. Il est inadmissible que ce Plan brouillon de Charest, illogique économiquement et écologiquement, soit mis de l’avant sans que le tout soit planifié sérieusement, et concertée avec la population.

Nous ne comprenons pas la sortie de certains élus qui demandent d’accélérer le processus pour le projet de loi 14. Nous allons dilapider nos ressources naturelles et laisser les générations futures sans redevances et avec tous les problèmes environnementaux. Nous sommes d’avis que nous devons prendre le temps de réfléchir pour notre futur. Rien à voir avec une décision à courte vue prise sur le coin d’une table!

Que le Québec maintienne ou décrète immédiatement des moratoires sur les filières à forts impacts, notamment les gaz de schiste, le pétrole et le gaz dans le golfe, les mines d’uranium et le nucléaire;

Bill 14 - More Amendments

This week should be a watershed (of sorts) for Quebec mining law. The Charest government is about to finalize (hopefully) some amendments that improve citizen rights vis-a-vis mining companies.

One of the big steps the government plans to take is to remove the right of mining exploration companies to seek expropriation of private property during the exploration phase. That coupled with the right of a property owner to refuse consent for exploration on their land effectively gives back control of private property to the property owner. This is welcome relief for many property owners in areas with mining claims activities. Combined with an amendment that will give regional county municipalities (MRCs) the right to exempt some land in its territory from mineral claims if the land is used for vacation properties, the new legislation is finally paying heed to some of the requests made by citizens for reform.

However, while the new legislation moves in the right direction on property and citizen rights, it does not move nearly so much on environmental concerns.

Here is a site that is signalling a new protest and encourages all citizens with mineral claims on their land to impose their own moratorium, which is possible even before the amendments go through.

Bill 14 - An Act to Amend the Quebec Mining Act

There may be a ray of light in rural municipalities and cottage country in West Quebec.

According to a report on Forbes.com, Bill 14, a bill that would amend the existing Mining Act, proposes the following:

"...mining activities would be withdrawn from urban perimeters and “areas dedicated to vacationing.” The Mining Minister would be able to exclude these zones and refuse certain mining rights in order to avoid conflicts with other territories.

The bill is currently seeking legislation."

While this does not address all of WQ-CAMU's objectives, nor those of the broader coalition Pour que le Quebec ait Meilleure Mine!, it is somewhat encouraging. (Note we do not intend to speak on behalf of the broader coalition here.)

We at WQ-CAMU have been fighting for this type of reform for some years. Our efforts to advocate changes to the Quebec Mining Act may be contributing towards progress (we say guardedly). We have had numerous communications over the last four years with the Government of Quebec to encourage it to be more balanced in how it manages lands and avoids conflicts.

It is somewhat surprising that the mining industry itself doesn't seem to disagree with settling the conflict once and for all around higher population centres. We consider it a reasonable compromise on this aspect of a complex problem.

Much more needs to be done, but it is a step in the right direction.

One of life's ironies just appeared today.

The Quebec mineral exploration association is all worked up about the potential loss of "rights" to exploration within municipal boundaries as predicated by Bill 14.

The association says: “We are entering a stage where companies and individuals, who feel their rights have been deprived and who have not been given a chance to negotiate, feel that, in order to have their rights respected, their only recourse is legal action."

To that we say: Welcome to the world of rural private property owners. Land owners have been facing a similar reality for generations. The state, for many decades, has granted conflicting surface and subsurface rights creating needless conflict between land owners and mineral prospectors.

Now that the balance is starting to be restored the prospectors are getting upset. It's easy to empathize but sympathy is out of the question.

Midland Exploration Updates its Progress on the Gatineau Zinc Project

Here is a West Quebec update from an April 14, 2011, news release issued by Midland Exploration:

Gatineau Zn Project - Optioned to Zincore Metals Inc. ("Zincore")

An important drilling campaign totalling about 2,000 metres in ten (10) holes is currently underway on the Gatineau Zn Project in partnership with Zincore. Targets to be tested mainly consist of airborne VTEM anomalies located near the Bouchette, Leitch, and Lafontaine zinc prospects. Channel sampling performed last fall in two trenches on the Leitch and Lafontaine deposits respectively returned grades of 24.1% zinc over 3.0 metres, including 32.5% zinc over 2.0 metres, and 21.0% zinc over 2.0 metres.

The Gatineau Zn Project is in the first year of an option agreement with Zincore, whereby Zincore may earn 50% interest by spending a total of $3,500,000 in exploration expenditures over four years and making payment totalling $180,000.

Terra Firma Withdraws from Restigouche: An Important Win for Baie des Chaleurs Uranium Opposition

Pointe a-la-Croix, Quebec – April 20, 2011. The Coalition Stop Uranium Baie des Chaleurs and the Citizens’ Committee of Pointe-à-la-Croix were very pleased to receive the news that Vancouver-based mining company Terra Firma Resources it is giving up its option on the Restigouche uranium prospect. “While an important victory for those of us who oppose uranium mining it’s still too soon to get out the champagne and celebrate,” says Coalition member Michel Goudreau.

With Terra Firma pulling out, the mineral claims will revert back to a local prospector who may try to find another company willing to invest in exploration activities. However, Luc Vallieres of the Citizens’ Committee points out that “any company who might think about doing exploration for uranium in our community will face the same opposition as Terra Firma”.

“This is an important victory for the Coalition but we won’t have really won until Quebec adopts a moratorium on uranium” added Mr. Goudreau. In Quebec and elsewhere in Canada uranium exploration and mining companies have faced stiff opposition from communities. In Quebec this has included communities on the North Shore, in the Laurentians and in Gaspé.

Minister of Natural Resources, Nathalie Normandeau and her government should understand that exploration and extraction of uranium are not environmentally, socially or economically sustainable. The massive volume of toxic, radioactive waste that uranium mining generates demonstrates this.

The Baie des Chaleurs coalition and the province-wide movement it belongs to, the Coalition Pour que le Québec ait meilleure Mine! (Quebec Better Mining Coalition), will continue to demand that Quebec follow Nova Scotia and British Columbia in implementing a uranium moratorium. The groups are also demanding changes to Quebec’s out-dated Mining Act so that municipalities and landowners have greater power to block mining projects that are not socially acceptable.

Last week, property owners with surface rights to 2,359 ha, about half of the Restigouche property, sent Terra Firma 125 registered letters prohibiting the company from undertaking any exploration activity on their properties. “The claims on public lands are still completely open for the company to explore, with virtually no oversight by the Ministry of Natural Resources and Wildlife. This is why we continue to pressure Minister Normandeau to implement a uranium moratorium. It is the only solution that, over the long-term, can protect the health and the environment in all parts of Quebec,” concludes Goudreau.

LES OPPOSANTS À L’URANIUM GAGNENT UNE PREMIÈRE MANCHE

La Coalition Stop Uranium Baie des Chaleurs et le Comité de citoyens de Pointe-à-la-Croix ont accueilli avec joie l’annonce par la compagnie Terra Firma Resources de son retrait de la propriété Restigouche, soit des trois blocs de claims miniers pour de l’uranium dans la Baie des Chaleurs. Bien que ce soit une belle victoire pour les opposants à l’uranium, le porte-parole de la Coalition Michel Goudreau croit « qu’il est trop tôt pour sortir le champagne. »

En effet, le retrait de la compagnie minière de Vancouver engendre le retour des claims miniers pour l’uranium à un prospecteur de la région qui peut se tourner vers une autre compagnie minière prête à investir dans des travaux d’exploration. Selon Luc Vallières du Comité citoyen qui a galvanisé l’opposition des propriétaires à Pointe-à-la-Croix, « toute compagnie qui pourrait avoir l’idée d’explorer pour de l’uranium sur notre territoire fera face à la même opposition ».

Pour la Coalition Stop Uranium, « nous avons gagné une première manche mais la partie ne sera vraiment gagnée que lorsqu’un moratoire sur l’uranium sera adopté au Québec. » Au Québec et ailleurs au Canada, les minières intéressées par l’uranium ont eu à affronter des blocus populaires, que ce soit sur la Côte Nord, dans les Hautes-Laurentides ou en Gaspésie. La ministre Nathalie Normandeau et son gouvernement devraient comprendre que l’exploration et l’exploitation d’uranium n’est pas une option durable tant aux plans environnemental, social, qu’économique en raison des grandes quantités de déchets toxiques et radioactifs découlant de cette activité.

La Coalition gaspésienne qui est membre d’un large mouvement au Québec, la Coalition Pour que le Québec ait meilleure Mine!, va continuer de revendiquer un moratoire sur l’uranium au Québec (comme l’ont accordé la Nouvelle-Écosse et la Colombie-Britannique) et des changements majeurs à la désuète Loi sur les Mines visant à accorder plus de pouvoirs aux municipalités et aux propriétaires aux prises avec des projets miniers non acceptables socialement.

Rappelons que la compagnie Terra Firma Resources de Vancouver a reçu la semaine dernière 125 lettres enregistrées de propriétaires de terrains situés sur les claims miniers à Pointe-à-la-Croix interdisant à la compagnie d’y effectuer tous travaux miniers. Cette démarche venait effectivement bloquer l’accès à un peu plus de la moitié du territoire convoité par la compagnie pour des travaux d’exploration d’uranium. La Coalition rappelle que les claims miniers en terre publique demeurent complètement ouverts à l’exploration minière pour l’uranium ou autres métaux sans véritable contrôle par le Ministère des Ressources Naturelles et de la Faune (MRNF). « Voilà pourquoi nous allons continuer de faire pression sur le ministère de Nathalie Normandeau : afin d’obtenir un moratoire sur l’uranium, car il s’agit là de la seule solution à long terme pouvant protéger la santé et l’environnement des populations de toutes les régions du Québec » de conclure Michel Goudreau, porte-parole de la Coalition Stop Uranium Baie des Chaleurs.

A Uranium Exploration Moratorium in the Baie-des-Chaleurs, Quebec

Uranium exploration is about to end in the Baie-des-Chaleurs region of Quebec. Minister Normandeau has announced she's instructed her Ministry staff to find a way to prevent further exploration in the area. We'll wait to see how this is accomplished and see how we can leverage this for West Quebec.

Quebec Asbestos Mine Re-Opening With Public Funds

Every now and then a story comes along that reveals a great deal of insight about a topic.

Mining in Quebec has been an important topic of debate for quite some time. For the last three years (at least) coalitions, community groups and NGOs have been arguing that some forms of mining (like uranium, open pit and asbestos) are too harmful to the environment and/or human health to be justified.

Today, the Quebec Government announced it will provide a $58 million loan guarantee, pledging Quebec taxpayers' money, to re-open the Jeffrey asbestos (chrysotile) mine in the city of Asbestos, Quebec.

This in spite of condemnation by the Quebec Government's own health experts.

The justification given is the creation of 400 jobs. Nothing trivial, and for the people who this might employ, probably a life blood for the short term. Long term, maybe not so good.

To illustrate how far behind the times the Quebec Liberal government is:

"The province's exposure limit for dangerous asbestos fibres is 10 times higher than other parts of Canada and 100 times higher than some European countries."

Asbestos dust has been linked to lung cancer and other lung diseases.

It goes to show the risks people are prepared to take to make money. It helps explain why concerns about uranium exploration and exploitation fall on deaf ears in the Quebec Government.

Time Magazine and Nuclear Power

While WQ-CAMU doesn't normally wade into the debate about nuclear power a well-written story appeared on Time's web site last Thursday. Since the end use of uranium is often nuclear power, it is hard to ignore the realities of that industry.

In summary, this article confirms the "nuclear renaissance" was a non-starter before the recent disaster in Japan. The only countries aggressively pursuing nuclear power are China and Russia (command-style economies), and their efforts will have insignificant impact on the reduction of greenhouse gases. Uranium Prices Fall on News of Japanese Nuclear Disaster

According to many sources, including the Financial Times and Bloomberg, uranium prices, and the stock prices of the companies exploring for and producing uranium, have crashed in the last few days.

Uranium prices on the spot market are down 27% to $50 US per pound since last Friday. [The spot price does not reflect the price in long-term contracts but may be indicative of trends in the future - ed.]

Uranium mining company stock prices are taking a beating:

Cameco: down 20% since March 10
Paladin Energy: down 25% since March 10
Uranium One: down 34% compared to pre-earthquake

The downdraft in stock prices is also pronounced in the non-producing exploration companies. According to Bloomberg the recent highs/lows of uranium explorers active in Quebec is illustrative:

Strateco Resources: Feb. 3/11 $1.30 - Mar. 18/11 $0.63 (drop of 52%)
Majescor Resources: Mar. 7/11 $0.27 - Mar. 18/11 $0.225 (drop of 17%)

The long touted "nuclear renaissance", which had already been faltering before the earthquake in Japan, is now apparently on hold for an indefinite period. That bodes well for anyone opposed to uranium exploration and mining.

Midland Exploration - Update on the Gatineau Zinc Project

The final report and data for the Leitch PROMIS follow-up was received. With all the data in hand, a consultant geophysicist modelized the VTEM-PROMIS conductors on both the Leitch and Bouchette properties to refine the drilling targets. A total of eight (8) diamond drilling targets were proposed on the Leitch (5 DDH) and Bouchette (3 DDH) properties. Diamond drill holes aiming VTEM-PROMIS and geological-structural targets started in January 2011.

According to financial statements Midland has invested $48,762 in deferred exploration expenses.

In April 2010 the Company optioned a promising zinc land package from Midland. The Gatineau project is located in the province of Québec close to major infrastructure. This project is known to host several significant zinc occurrences and it shares many similarities with the prolific Balmat-Edwards District, located only 60 kilometres to the south. The zinc mineralization occurs as either conformable to relict bedding within certain stratigraphic horizons, or within cross-cutting, ductile shear zones.

In the Gatineau area, there are more than 40 zinc, zinc-iron and iron showings and prospects that are mainly concentrated in the west part of the Grenville meta-sedimentary belt (Gatineau-Maniwaki area). The zinc and zinc-iron occurrences are hosted in dolomitic marbles and found occasionally in association with overlying iron formation, those being sulphide-rich, iron oxide-rich and/or carbonate-rich.

Semi-massive to massive sulphide mineralization has been noted on seven different locations within the optioned land package namely, the Bouchette-DesNègres, Leitch-Lafontaine-Parker and Lemieux-Route 107, Blue Sea, and Kilmar horizons. Typically the massive sulphides contain 25% sphalerite, 25% pyrrhotite, 15% pyrite and trace chalcopyrite in a matrix made mainly of diopside and variable amounts of calcite, phlogopite, tremolite, scapolite and rare quartz. The sulphides are homogeneous, granular and vary in size from medium to coarse (5 to 10 mm).

During 2007 and early 2008, Midland conducted a limited combined magnetic and electromagnetic helicopter survey (VTEM) over some of the known mineralized areas within the Gatineau project area. The combined EM and magnetometric survey proved to be very effective to map buried favourable geology unknown until now. Preliminary results indicate that the new survey has detected conductors on several lines with some of them having a good magnetic association.

The exploration program on the Gatineau project started in July 2010 with some ground geophysical surveys and additional geological mapping of priority AEM targets. Two trenches were recently completed to obtain further geological data in order to orient a future drilling campaign. Channel sampling, on both sites, revealed a zinc rich massive sulphide horizon. On one trench, a total of 35 samples were collected from six channels through the massive sulphide horizon, traceable over an 80 metre strike length. Best results returned 24.1% zinc over 3.0 metres, including 32.5% zinc over 2.0 metres. On the second trench, located to the southwest, a total of 14 samples were collected from three channels through the massive sulphide horizon. Best results returned 21.0% zinc over 2.0 metres. Overall, a total of 12 intervals, 0.5 metre long have returned assays over 30% zinc, including a value as high as 43.13% zinc. Drilling is expected to begin prior to year end.

It's associated financial statements suggest it has spent $195,000 on the Gatineau Zinc Project and accrued a further $335,000 towards it.

Cette action démontre aussi que la Loi sur les mines et le projet de loi 79 visant à la modifier ne répondent pas du tout aux attentes de la société d’aujourd’hui », insiste Ugo Lapointe, l’un des porte-paroles de Québec meilleure mine !

Depuis le début de l’année, près d’une cinquantaine de propriétaires de Saint-Camille ont fait parvenir des lettres à la compagnie minière Bowmore, une filière d’Osisko à Malartic, en lui interdisant d’effectuer tout travail d’exploration sur leurs terrains. Ces propriétaires invoquent leur droit à une entente à l’amiable préalable, telle que référée aux articles 65, 170 et 235 de la Loi sur les mines. En contrepartie, l’article 235 de la Loi sur les mines permet aux compagnies de recourir à l’expropriation des propriétaires et des locataires fonciers pour exécuter leurs travaux d’exploration si elles ne réussissent pas à s’entendre avec eux. « C’est donc un véritable test pour tout le monde : le citoyen, la compagnie et le gouvernement responsable d’appliquer la loi », explique Christian Simard de Nature Québec.

Tester la loi... et le gouvernement

« S’il accorde à la compagnie ses droits de recourir à l’expropriation, le gouvernement s’expose à de vives critiques et à un tollé général de la part de la population. S’il n’accorde pas les droits à la compagnie, il s’expose non seulement à des recours possibles de la part de celle-ci, mais il ouvre également la porte pour que tous les propriétaires et les locataires fonciers du Québec en fassent de même face aux gazières, minières et autres compagnies qui souhaitent exécuter des travaux sur leurs terrains », affirme Ugo Lapointe.

« La situation de Saint-Camille démontre également le ridicule de la loi actuelle face à la position même du gouvernement. On entend depuis plusieurs semaines Mme Normandeau et son gouvernement affirmer « qu’il n’y a jamais eu d’expropriation à l’étape de l’exploration et qu’il n’y en aura pas ». On entend également les associations minières et gazières affirmer « qu’il faut absolument le consentement des propriétaires avant d’effectuer des travaux sur leurs terrains ». Bref, si « tout le monde s’entend », alors pourquoi ne pas éliminer une fois pour toute le droit d’exproprier des citoyens au stade de l’exploration ? Ça règlerait bien des problèmes et ça répondrait aux attentes de la société d’aujourd’hui », insiste Henri Jacob de l’Action boréale de l’Abitibi-Témiscamingue.

Rappelons que la coalition Québec meilleure mine ! demande la réécriture complète du projet de loi 79 sur les mines, qui ne répond pas du tout aux attentes que répètent le monde municipal, les travailleurs, les citoyens et les organismes environnementaux. Au cœur de cette réforme est la nécessité d’éliminer la préséance de la Loi sur les mines sur les droits des citoyens et des autres utilisateurs du territoire. L’actuel projet de loi 79 est en suspend et pourrait bien tomber avec la prorogation de la session parlementaire à Québec. Entre temps, le statu quo et le régime de privilèges continuent de s’appliquer pour l’industrie.

City in Virginia Publishes Study of Potential Impact of Uranium Tailings Dam Failure on Drinking Water Supplies

Virginia Beach Releases Results of Uranium Mining Study

Release Date: Tuesday, February 1, 2011 4:30 p.m.

The City of Virginia Beach today released findings of a study conducted in response to Virginia Uranium Inc.’s plan to develop a uranium mining operation in Pittsylvania County. This area in southwest Virginia is believed to contain a very large untapped deposit of uranium, but the site could be susceptible to heavy rains and flooding. This poses the threat of radiation flowing into downstream drinking water supplies, including Lake Gaston, which supplies drinking water to Virginia Beach and, indirectly, Chesapeake and Norfolk.

The study concluded that impacts to the drinking water supplies would be significant but not permanent after a worst-case storm. Depending on weather conditions, it could take two months to two years to completely flush radioactive contaminants out of Lake Gaston. Environmental and water quality impacts upstream would be greater and longer lasting.

A state ban on uranium mining would need to be lifted by the General Assembly before mining operations could begin. Virginia Uranium Inc. is seeking to have the General Assembly overturn the ban.

POINTE-À-LA-CROIX - A citizen's committee in Pointe-à-la-Croix, in co-operation with Coalition Stop Uranium Baie des Chaleurs, is holding meetings this month to convince the Quebec government to stop uranium exploration. One such meeting is scheduled for Thursday, Jan. 27 at 7 p.m. (Quebec time) at the Centre polyvalent (next to the school) in Pointe-à-la-Croix. A Vancouver mining company, Terra Firma Resources, is planning to explore for uranium this spring and has acquired mining claims near Pointe-à-la-Croix, Listuguj and in the Escuminac river watershed. Groups opposing uranium exploration say it could cause adverse health effects. Representatives from government and Listuguj First Nation have been invited to speak. Inka Milewski of the Conservation Council of New Brunswick will be making a presentation as well. She'll speak about her own experience, having spent her childhood in a uranium mining town in Ontario.

Quebec Delegation Visits Uranium Mines in Saskatchewan

Delegation hasn't addressed Quebeckers' concerns about uranium

Saskatoon – January 14, 2011.

For the last three days MiningWatch Canada’s Canada Program Coordinator Ramsey Hart has been participating in a delegation examining the uranium mining industry in Saskatchewan. The group of thirty made stops in Regina, Saskatoon, at the Rabbit Lake Mine and at a mill in northern Saskatchewan.

The Quebec Ministry of Natural Resources and Wildlife organized the delegation. Delegates included Minister Serge Simard, ministry staff, regional and Quebec health representatives, and elected officials and staff from the North Shore and James Bay regions. The Coalition Québec Meilleure Mine (Better Mining Coalition) invited Mr. Hart to participate in the delegation as their delegate.

Uranium mining and Quebec’s continued use of nuclear power are controversial issues in the province. With a number of groups, including the Coalition Québec Meilleure Mine, calling for a moratorium on uranium exploration. There has never been a uranium mine in Quebec, but the federal and provincial review committees are currently completing a report on an advanced exploration project in the Mont Otish Region. It and other exploration projects in the North Shore, Ottawa River, Mont Laurier and Gaspé areas have met with stiff opposition.

During the visit to Saskatchewan, presentations were made by provincial government officials, a medical doctor and industry. Delegates also had a chance to tour the Rabbit Lake Mine operated by Cameco and meet members of the local Dene community. Local community representatives expressed appreciation for employment created by the mines, which have relatively high employment rates for Aboriginal people. They also, however, expressed their frustration that there is no agreement for community benefits and revenue sharing with the province or company. Furthermore, they remain concerned about protecting the area's water supply and about rising cancer rates in the community. The doctor responsible for regional health indicated that there are more likely causes for high cancer rates, but the concern persists among some community members. Unfortunately, no Indigenous participants from Quebec were part of the delegation.

“The trip provided important information about the risks and regulation of the industry,” commented Hart, “however, most presenters only provided general information. They made references to studies, but did not show concrete results, nor did they describe the environmental impacts that have occurred at the mine sites.”. Each of the mines must carry out Environmental Effects Monitoring, but none of the data from these studies was presented to the delegation.

During the mine tour, delegates learned that in recent years Cameco has taken steps to substantially reduce contamination flowing into nearby Walaston Lake. The expertise and expense required to reduce uranium, selenium, molybdenum and arsenic pollution arising from uranium mines is significant. “It raised concerns for me about smaller junior companies operating in Quebec and seeking to exploit much less rich deposits that those in Saskatchewan (the richest in the world). Do they have the expertise and financial capacity to invest in these kinds of systems?” questioned Hart.

In discussing waste management and decommissioning, emphasis was placed on covering and planting the waste piles with grass, including pictures of attractive rolling hills. The complex and challenging issues of managing water movement and drainage through wastes, which retain 85% of the original ore's radioactivity, along with many other toxins, were not discussed in detail with the delegation. “I don’t think this kind of oversimplification does justice to the efforts companies are undertaking nor does it provide a complete picture to the delegates,” added Hart.

Risks associated with uranium mining are just one of the reasons groups are seeking a moratorium on uranium mining. Additional concerns pertain to risks associated with processing, managing (?) high-level nuclear waste, and the uses of uranium, such as nuclear power, nuclear arms, and depleted uranium weapons.

As the delegation leaves Saskatchewan, questions remain about the implications of uranium mining and these other issues that Quebeckers must grapple with to arrive at a decision about uranium exploration and mining.

Midland Exploration has issued a press release dated January 11, 2011 announcing a drill program for it's Gatineau Zinc project.

This is the first time drilling will take place and it consists of "...a minimum of eight holes totalling 1,500 metres of drilling."

Midland Exploration - Update on Exploration Activities in West Quebec

Midland Exploration Inc., in partnership with Zincore Metals Inc. announced November 2, 2010, they've finished their first year exploration program on their Gatineau Zinc Project.

They have conducted $500,000 of trenching work on the Leitch and Lafontaine zinc deposits. They are located north of Kazabazua and east of Blue Sea and Bouchette.

The total Gatineau Zinc Project budget is $3,500,000 over a few years.

"...After [the] 2nd World War, exploration works led the discovery of the Lafontaine and Leitch deposits and several mineralized showings. These deposits respectively contain historic resources of 27,000 tonnes at 12% Zn and 57,000 tonnes at 8% Zn.

...In the Bouchette-Leitch sector, the Lafontaine deposit was mined by Norzinc Mines in 1953, producing 20,000 tonnes of ore at 14% Zn (open pit, 12 m of depth). The Leitch deposit has [a] historic resource of 75,000 tonnes of ore at 8% Zn (St-Joseph Explorations, 1980). The Bouchette deposit was traced by holes and trenches over 1.3 km of length.

...In 2007 and 2008, geochemical and geophysical surveys done by Midland identified new targets for drilling.

A one-year study intended to assess the statewide consequences of uranium mining in Virginia begins this week when a National Academy of Sciences panel convenes for two days in Washington, D.C.

The 13-member study committee has a broad charge to assess the implications of lifting a 1982 ban on uranium mining in Virginia. Its conclusions are due in December 2011, and will be key to any General Assembly deliberations to lift the ban.

The proposal has met fierce opposition from some local residents who fear the mining and milling of the ore will foul local farm fields and streams and water sources for localities as far away as Hampton Roads.

The provisional members of the study panel, some of who have been challenged because of their ties to mining or the nuclear-power industry, are meeting in Washington to hear from a lineup of government officials, according to an agenda for the Board on Earth Sciences, a division of the National Academy.

Québec, mardi 26 août 2010 – La prochaine émission La facture, diffusée sur les ondes de Radio-Canada mardi le 26 octobre à 19h30, présentera les points de vue de citoyens et de familles qui se sont sentis floués et abandonnés par la compagnie minière Osisko et par la puissante Loi sur les mines du Québec. « Ce que la Loi sur les mines a permis à la compagnie Osisko de faire à Malartic ne devrait plus jamais être permis au Québec. Beaucoup trop d’individus et de familles ont souffert avec la disparition du quartier sud de Malartic et la relocalisation de plus de 200 résidences et de 5 institutions. Il faut agir autrement pour mieux protéger les citoyens qui font face à des projets miniers », insiste un membre d’une des familles affectée par le mégaprojet de mine à ciel ouvert d’Osisko à Malartic.

Dans le cadre de la réécriture de l’actuelle Loi sur les mines du Québec, le Comité de vigilance de Malartic et la coalitionQuébec meilleure mine! rappellent leurs principales recommandations pour mieux protéger les citoyens face aux compagnies minières, gazières ou pétrolières:

Éliminer la possibilité d’exproprier des citoyens à l’étape de l’exploration minière (article 235 de la loi);
Exiger l’autorisation écrite des propriétaires privés et des locataires fonciers avant que tout travail d’exploration minière soit exécuté sur leurs terrains (articles 65 et 235 de la loi);
Interdire l’achat et le déménagement de résidences tant que des audiences publiques du BAPE ne sont pas complétées et qu’un décret du gouvernement autorise un projet minier;
Fournir une aide juridique aux citoyens afin de les informer de leurs droits et de les soutenir en cas de différends lors de la négociation d’ententes d’achat ou de déménagement de résidences pour la réalisation d’un projet minier.

La mise en œuvre de ces recommandations permettrait de mieux protéger les droits des citoyens, de répondre à plusieurs des avis du BAPE concernant le projet d’Osisko (rapport juillet 2009, p.49), ainsi que d’harmoniser la Loi sur les mines du Québecavec plusieurs des dispositions de la nouvelle Loi sur les mines en Ontario. « Malheureusement, déplore la coalition Québec meilleure mine!, les ministres responsables Mme Nathalie Normandeau et M. Serge Simard ne semblent pas avoir compris l’urgence d’agir, puisque le projet de loi actuel n’intègre aucune de ces recommandations. Souhaitons qu’ils corrigent le tire d’ici l’adoption de la nouvelle loi, prévue pour la fin de cet automne à l’Assemblée nationale », affirme la coalition Québec meilleure mine!.

Rappelons que le projet Osisko propose d’extraire plus de 300 millions de mètres cube de roches du territoire de la municipalité de Malartic sur une période de 9 à 14 ans, et ce, pour une quantité totale d’or récupérable de moins de 10 mètres cube (servant principalement à l’industrie de la joaillerie et aux marchés financiers). Chaque jour, c’est plus de 120 000 tonnes de roches qui seront extraites à la dynamite et transportées par des centaines de voyages de camions, plus de 25 millions de litres d’eau qui seront utilisés pour traiter le minerais et près de 11 tonnes de cyanure qui serviront à la dissolution de l’or. À elle seule, la mine d’Osisko produira annuellement au moins 3 fois plus de résidus miniers que l’ensemble des 9 mines déjà en opération dans la région en 2007/08.

Classic Example of Mining Industry Rhetoric

In reading Mining Weekly's recent summary of the Fraser Institute's Survey of Mining Companies: 2010 Mid-Year Update, a classic example of mining industry blather was mentioned.

According to the survey, one opinion about Quebec's mining regime was as follows:

"Canada’s Quebec province, an exploration company president said, was fast declining as a place to do business, because its government had no clear policy and was guided by the flow of public opinion rather than common sense." [Our emphasis.]

The statement above is rather meaningless since no example of "common sense" was provided.

If the statement were made to say what was most probably meant, and to be reflective of the mentality of many in the mining industry, it would go like this:

"Canada’s Quebec province, an exploration company president said, was fast declining as a place to do business, because its government had no clear policy and was being pressured by public opinion rather than just the mining industry lobby."

Mock Mining Camp in Quebec City Makes a Point

The Coalition has set up a mock mining camp on the front lawn of the National Assembly to show how easy it is for mining companies to stake claims in rural Quebec, often against the wishes of local residents and municipal governments.

Terra Ventures Leaves Sept-Iles

It looks like the protests against a possible uranium mine near Sept-Iles have paid off. Terra Ventures has announced it is pulling up stakes at its Lac Kachiwiss property and leaving its exploration site.

There are mixed views about the impact of high profile public protests against the exploration activities. In the end though the public has asserted their wish to not have this type of activity near their water source.

The public will appears to be prevailing. In our view that is a good thing. Why shouldn't communities have a big say in the industrial development that takes place around them. Given the recent track record of certain oil and gas companies lately, it does give one pause to think about what industrial calamity might take place nearby.

When fresh water supplies are at potential risk, all the more reason for caution to prevail.

Expropriation of Private Property for Mining - Policy Trumped by Law

The West Quebec Coalition Against Mining Uranium (WQ-CAMU) has been assured by the Government of Quebec, upon pointed enquiry, that expropriation for mining purposes has not occurred in Quebec for at least the last twenty years.

Furthermore, the Government of Quebec has assured WQ-CAMU that it's policy is to respect the wishes of land owners if a mining company intends to violate private property rights. Property owners have the option to refuse consent to mineral exploration and development on their land according to the Ministry of Natural Resources and Wildlife.

WQ-CAMU explicitly asked the Quebec Government to put their policy into law and protect private land owners. The Government refused, saying there was no need.

Today's forcible eviction of Ken Masse in the Malarctic Region of West Quebec flies in the face of these assurances by the Government of Quebec.

Mr. Masse was removed from his home today by police clearing the way for a mining company to dig a huge open pit mine under his house.

WQ-CAMU has been concerned about the fragile state of government policy in the face of Quebec mining laws that contain the threat of expropriation.

Unfortunately it's concerns have been well founded.

Aerial Surveys in West Quebec

Since at least Sunday, July 4, an intense amount of aerial surveying has been underway in West Quebec.

A four-engine propeller plane with four-corner wiring and objects being dragged behind the aircraft on cables has been spotted near Duclos, East-Aldfield and Thorne. It appears to be flying grid patterns with very tight parallel lines (perhaps 200 metres apart). The plane flies very low and very slowly.

The aircraft lettering says Fugro. Fugro is a wordwide company with operations in several locations in Canada including Ottawa. According to its web site Fugro provides survey services including:

"Airborne photogrammetry, lidar, and radar mapping; topographic, hydrographic and geological surveying; geospatial data production and management; support services for offshore and onshore construction projects; precise positioning."

Midland Exploration Inc. Announces New Exploration Deal with Zincore Metals Inc. for the Gatineau Project

Midland Exploration (TSX VENTURE:MD) announced at the end of April the signing of a letter of agreement with Zincore Metals (TSX: ZNC) for the Gatineau Zinc project, which is currently held 100% by Midland. The project which comprises 266 claims covering a surface area of 160 square kilometres is located a few kilometres north of the city of Gatineau.

This deal is concerning because previously Midland was working with Breakwater Resources to explore these claims but the financial crisis caused Breakwater to pull out, thus putting an end to exploration in the area. Now Midland is back with a new and serious partner.

The deal calls for exploration expenditures of $700,000 in the first year (firm commitment of $500,000) with additional expenditures of $2,800,000 for a total of $3,500,000 over four years.

Midland is confident it will find a major zinc deposit in its Gatineau Project. Watch for ground geophysical follow-up, trenching, and subsequent diamond drilling during the summer of 2010.

Where's Stelmine?

A few short months ago the Ottawa Citizen and the Low Down to Hull and Back News both reported Stelmine Canada had purchased a number of mining claims in the Wakefield area. Stelmine was reportedly searching for Lithium and Rare Earth Elements.

Stelmine has issued press releases stating they have bought these mining claims, but GESTIM Plus, the Quebec Government's mining database, has no record of Stelmine owning claims in the vicinity of Wakefield. Either Stelmine is experiencing a hyperbolic lapse or the Quebec mining claims process is so opaque that citizens can not find out who owns the mineral rights underneath their property.

Right now, the Val-des-Monts area claims map shows a number of claims that could well correspond to those "owned" by Stelmine, but they are held by individuals. It is not possible to tell if a private deal has been made between Stelmine and these individuals to somehow effect an ownership change or similar arrangement.

In any event, Stelmine remains invisible to the public in GESTIM Plus around Wakefield and makes no mention of the Wakefield project on its own website (see: http://www.stelmine.com/projets_eng.php) other than through the original press releases: http://www.stelmine.com/presse_eng.php?id=03dec09 and http://www.stelmine.com/presse_eng.php?id=15dec09.

That doesn't mean Stelmine isn't busy doing airborne surveys of its claims, digging trenches or perhaps even diamond drilling on the ground - we the citizens can't find out.

Quebec Once Again Is the Most Mining-Friendly Jurisdiction in the World

Bravo Quebec - we have the dubious distinction of being recognized as the most mining-friendly district in the world according to the Fraser Institute. Quebec has been in the top 10 since 2001 and in the first spot for 2007, 2008, and 2009.

Could it have anything to do with generous corporate welfare (subsidies, support, infrastructure), poor protection of property rights, weak environmental laws, great tax breaks (credits and flow-throughs) and the primacy of mining rights over other rights?

Québec, le 25 mars 2010 — Dans une lettre en réponse aux pétitions de 14 000 signataires demandant un moratoire sur les mines d’uranium à Sept-Îles et au Québec, le ministre Serge Simard, au nom du gouvernement, refuse d’instaurer un tel moratoire, jugeant qu’il est « injustifié » et qu’il nuirait au climat d’investissement minier au Québec. La coalition Pour que le Québec meilleure ait mine! dénonce cette position du gouvernement, qui répond davantage à l’intérêt d’un petit nombre de compagnies minières qu’à celui du bien être général de la population. « Après avoir semblé favorable à un moratoire, au moins au niveau local, le gouvernement plie aujourd’hui devant le lobby minier au détriment de la santé publique, de l’environnement et de la qualité de vie d’une majorité. Il le fait à la veille d’une consultation générale en commission parlementaire prévue pour débattre de ces questions. C’est insensé et anti-démocratique ! » dénonce Christian Simard de Nature Québec.

Craintes de poursuites et de compensations
De façon à peine voilée, la lettre révèle également que le gouvernement craint des poursuites judiciaires de la part des compagnies minières advenant la mise en place d’un moratoire. « Cette attitude d’aplat-ventrisme est inacceptable de la part d’un gouvernement responsable comme le Québec. Les gouvernements de la Colombie-Britannique et de la Nouvelle-Écosse n’ont pourtant pas hésité à mettre en place des moratoires dans leurs provinces. Si des compagnies minières ont fait des menaces au gouvernement, qu’on nous dévoile leurs noms! Autrement, ce n’est que de la pure spéculation. C’est à se demander pour qui gouverne le gouvernement actuel, pour l’industrie ou pour la population ? » se demande Ugo Lapointe, l’un des porte-paroles de la Coalition.

Dénis des risques et des dangers
Alors que la Commission canadienne de sûreté nucléaire et la Santé publique du Québec n’ont jamais nié la présence de risques et de dangers liés à l’exploitation de mines d’uranium, la lettre signée par le ministre Simard leur fait pourtant dire le contraire. « C’est aberrant! Soit le ministre Simard est mal informé, soit il ment. Dans les deux cas, il doit se rétracter et corriger les faits », insiste Marc Fafard de Sept-Îles sans uranium.

La Santé publique du Québec a d’ailleurs mis sur pied, en janvier 2010, un comité d’étude pour caractériser l’ensemble des risques et des dangers liés à l’exploration et l’exploitation de mines d’uranium. « Les conclusions de cette étude ne seront pas connues avant un ou deux ans de travail et d’analyse. Entre temps, il semble inconcevable qu’on n’impose pas immédiatement un moratoire sur toutes nouvelles mines d’uranium afin de ne pas hypothéquer la santé des populations et la qualité de l’environnement » explique Marc Fafard.

Lucie Martineau, présidente du Syndicat de la fonction publique du Québec (SFPQ), un organisme important qui vient de se joindre à la Coalition, est du même avis « Un moratoire sur toutes nouvelles mines d’uranium serait l’approche la plus prudente dans le contexte actuel. Un moratoire permettrait de respecter les principes de prévention et de précaution de la Loi sur le développement durable, adoptée en 2006, tout en donnant le temps nécessaire au gouvernement de prendre une décision en toute connaissance de cause ».

Pressions accrues du lobby minier
« Nous ne sommes pas dupes des pressions qu’exerce présentement le lobby minier sur le gouvernement et sur nos élus. Face à un moratoire présentement réclamé par une majorité des communautés directement affectées, les compagnies uranifères paniquent! Plutôt que de respecter la volonté de la population et de se retirer, ces compagnies préfèrent attaquer et discréditer la réputation des individus qui « osent » parler des risques et des dangers de cette industrie. Ce sont des pratiques rétrogrades que nous dénonçons » affirme François Lapierre de l’Association de protection des Hautes-Laurentides.

Plainte à l’Ordre des géologues
C’est d’ailleurs hier que la Coalition a déposé formellement une plainte à l’Ordre des géologues du Québec. La Coalition reproche à des membres de cet ordre d’avoir enfreint leur code de déontologie en transmettant au public des informations incomplètes et inexactes concernant les risques liés à l’exploitation de mines d’uranium. La Coalition reproche également leur manque de transparence et d’intégrité, en omettant de révéler clairement les conflits d’intérêts qui les lient avec des compagnies et des projets d’uranium au Québec. Rappelons que les mines d’uranium génèrent d’importantes quantités de déchets et de résidus miniers radioactifs dont les risques pour la santé et l’environnement perdurent sur des milliers d’années. À notre connaissance, il n’existe encore aucune méthode et aucune technologie qui permettent d’éliminer ces risques à long terme.

D’ici la caractérisation complète de ces risques et de ces dangers, ainsi que de la prise en considération des alternatives à l’uranium et au nucléaire, les membres de la Coalition répètent avec insistance la nécessité d’instaurer un moratoire sur les mines d’uranium au Québec.

à l’Assemblée nationale des pétitions regroupant plus de 11 000
signataires en faveur d’un moratoire sur les mines d’uranium, la
coalition Pour que le Québec ait meilleure mine ! annonce qu’elle
portera plainte à l’Ordre des géologues du Québec puisqu’elle juge
que des membres de cet ordre ont enfreint leur code de déontologie
en transmettant au public des informations incomplètes ou inexactes,
dépassant parfois leur propre champ de compétence. La Coalition
reproche également à ces individus un manque de transparence face
au public, en ne révélant pas explicitement leurs conflits d’intérêts en
lien avec des projets miniers d’uranium.

« Ce que l’on déplore, c’est le manque flagrant d’impartialité et de
professionnalisme de certains géologues, qui enfreignent non
seulement leur propre code de déontologie, mais qui jettent
également une ombre sur l’ensemble de cette profession. Sous le
couvert de leur titre professionnel, nous jugeons qu’ils sont allés
beaucoup trop loin cette fois-ci. C’est pourquoi nous portons plainte »,
explique Christian Simard de Nature Québec.

La Coalition juge que les géologues professionnels qui ont signé un
communiqué de presse en décembre 2009 ont manqué à leurs
devoirs envers le public. « Le fait de transmettre des informations
incomplètes et de ne pas expliquer clairement au public l’ensemble
des faits et des incertitudes qui demeurent quant aux risques et aux
impacts liés à l’exploitation des mines d’uranium ne respectent pas
du tout l’esprit du code de déontologie », explique Ugo Lapointe,
l’un des porte-paroles de la coalition.

La Coalition blâme également le manque de transparence et
d’intégrité des professionnels qui ont signé cette lettre, dont elle
estime qu’au moins le tiers possède des intérêts économiques
directs dans des projets miniers d’uranium en cours.

« Il est temps que les professionnels du secteur minier comprennent
que « intérêt public » n’égale pas forcément « une mine » et « des
jobs » ! Il est temps qu’ils comprennent également qu’ils ont le devoir
d’informer le public sur les risques et les impacts liés aux mines
d’uranium, et non de prétendre que ces risques n’existent pas et
d’induire ainsi le public en erreur », insistent François Lapierre du
Réseau québécois des groupes écologistes.

Le code de déontologie demande également les géologues
professionnels de respecter l’indépendance professionnelle et le
champ d’action d’autres disciplines. « Ils ont donc un devoir de
réserve et de respect envers les professionnels de la santé,
notamment ceux de la Santé publique de la Côte-Nord qui travaillent
présentement à caractériser l’ensemble des risques et des dangers
de cette industrie », ajoute Marc Fafard de Sept-Îles sans uranium.

Il faut rappeler que les mines d’uranium génèrent d’importantes

Factsheet on West Quebec Uranium Exploration

Hundreds of mining claims blanketing tens of thousands of acres are currently active in West Quebec according the the Ministry of Natural Resources and Wildlife.

Recent trends indicate the number of newly filed claims is beginning to climb again for the first time in about a year, as some previously registered claims continue to expire. Low commodity prices, weak financial markets and the global recession continue, with few exceptions, to be taking their toll. Nevertheless, a great deal of private and public land in West Quebec remains subjected and subjugated to the mining industry's privileged and preferential access to territory.

The referenced territory ("West Quebec") spans Maniwaki to the north, Fort-Coulonge to the west, La Pêche to the south and Notre-Dame-de-la-Salette to the east. Both Crown land and private property are affected. The claim blocks overlap several designated wildlife habitats and urban perimeters (areas of human settlement).

The vast majority of these claims are thought to be for uranium but a minority are reportedly for zinc, lead, palladium and more recently rare earth elements.

Four major concentrations of uranium claims are found. One is in La Pêche, centred around Lac des Loups (Wolf Lake), Duclos and East Aldfield (up as far as Lac Sinclair). New claims have been filed since the summer in this area. The other three are in the Pontiac near Fort-Coulonge/Mansfield/Thorne (where new claims are also starting to re-appear), Otter Lake (south of more new claims) and on Grand-Calumet Island (in the heart of the Ottawa River), an area that has been gradually seeing reduced claims activities.

Many property owners have been alarmed to discover they do not own the sub-surface (mineral) rights to their land. These rights (with rare exception) are owned by the Quebec Government and are available for mining claims via the Internet by anyone who pays a $50 per claim fee.

Mining claims vary is size but they can be as large as 150 acres (60 hectares) each. The initial mining claim is valid for two years. For the claim to be renewable about $1,200 worth of exploration work must be done in that time frame.

One company that was involved in exploration in La Pêche and the Pontiac is Aldershot Resources Ltd. of Vancouver. In early August 2007 it published exploration results from its team of 13 prospectors in the Fort-Coulonge area signalling an interest in three mineralized zones and started conducting channel sampling and trenching at those locations. In the fall of 2007 it added another 25 claims adjacent to those already in its hands in the Pontiac. In public filings since the fall of 2008, Aldershot proclaims it has abandoned all its claims in Quebec due to lack of financial resources. Notwithstanding these assertions according to the GESTIM mining claims system Aldershot still owns a number of claims northwest of Fort-Coulonge.

Hawk Uranium was active on Grand-Calumet Island and held a public meeting June 11, 2007 to present its 2007 uranium exploration program on its properties on the Island. This poorly announced meeting was attended by about 40 - 50 residents, most of whom are opposed to uranium exploration and mining. In public filings since the fall of 2008 Hawk stated it was not actively exploring its properties on Grand-Calumet Island due to blocked access to claims by surface rights owners.

The Quebec Ministry of Natural Resources and Wildlife says exploration work can not be done on private property without the consent of property (surface rights) owners and that it will not support any expropriation of land by prospectors or mining companies (although the Quebec Mining Act makes expropriation legal). There have been at least three reported instances of trespassing by exploration personnel on private property. One was in the Pontiac and two were in La Pêche.

The reality is physical relocation of private dwellings and institutions is a possibility in Quebec as demonstrated by the 2009 Quebec government approval of the Malartic open pit gold mining project in the Abitibi-Temiscamingue region. That project involves moving a neighborhood of 75 residences, along with a new elementary school, a day care facility, and an adult training center to make way for the new mine. The mine site itself will be immediatlely adjacent to the community that lives there.

A petition from citizens in La Pêche with hundreds of signatures opposing uranium exploration and mining and requesting a moratorium we presented to the Premier of Quebec and the Minister of Natural Resources and Wildlife in 2007. To date well over 2,800 signatures have been collected.

La Pêche Municipal Council passed a unanimous resolution requesting a moratorium on uranium exploration and a safety study from the Quebec Government (April 2007) – it, along with the petition, was acknowledged by the Ministère du Développement durable, de l'Environnement et des Parcs.

Chelsea Municipal Council passed a similar resolution in early June 2007. Also, in June 2007, the Mayors' Council of the MRC des Collines de L'Outaouais passed a supporting resolution adding the municipalities of Pontiac, Notre-Dame-de-la-Salette, L'Ange-Gardien, Val-des-Monts and Cantley to the roster of communities supporting La Pêche's opposition to uranium exploration and mining.

Cantley Municipal Council passed its own uranium moratorium resolution in May 2008 and asked that the MRC des Collines de L'Outaouais do the same thing.

On July 11, 2007, Ecojustice Canada sent an open letter to the Quebec Minister of Natural Resources and Wildlife advocating changes to the Quebec Mining Act. (The letter was re-submitted in October 2007 in response to a Quebec Government public consultation on a mineral strategy for Quebec - see below).

The Quebec Government responded by affirming consent is required from property owners before an exploration company can access the land; by saying it does consider all uses of land before granting mineral rights and that it would be taking Ecojustice Canada's comments into consideration.

Concerned citizens in the MRC de Pontiac have had discussions with the Amenagement du Territoire Committee and the mayors of the county regarding their concerns about uranium mining. Concerned citizens along with the Canadian Parks and Wilderness Society held two public awareness sessions on August 29 and 30, 2007 at the Cinema Lyn in Fort-Coulonge. Movies on eco-tourism and uranium mining were screened. The sessions were attended by over 175 citizens.

The Quebec Government has written to the Municipality of La Pêche to say it will not grant the Municipality its requested uranium exploration and mining moratorium because it supports the principle of "free entry" and the exclusive development of minerals by whoever discovers them (with conditions).

The Quebec Ministry of Natural Resources and Wildlife announced on September 6, 2007 a "public" consultation on the Quebec mining strategy. More information is available here: http://no-uranium.blogspot.com/2007/09/minister-bechard-announces-brief-public.html.

The consultation was not well publicized, there were no public hearings and all submissions were either made by mail or via the Ministry's web site. There were however "special" consultations held with representatives of the mining industry.

SOQUEM Inc., a wholly owned Crown company of the Quebec Government, was found to have registered dozens of claims in West Quebec, including 37 in La Pêche, in October 2007. This prompted an outcry about potential conflict of interest given the Quebec Government had recently denied a moratorium request in La Pêche. SOQUEM claims it is exploring for palladium, not uranium, and therefore is in no conflict.

There is no way to verify this information since SOQUEM is a "private" Crown company and files no public reports of its own about its activities. It's parent company Societe generale de financement du Quebec publishes consolidated information by portfolio. SOQUEM's web page does not even provide a phone number or address. It is however a partner in uranium exploration activities in the Otish Mountains region of Quebec.

In June 2009 the Quebec mineral strategy was finally published. The strategy essentially offered new incentives to the mining industry and did precious little to protect the environment, municipal planning powers or private property. In October 2009 Ecojustice Canada publishes a report called "Setting A Gold Standard: Reforming Quebec's Mining Act." The document advocates several key changes to mining legislation to protect the environment, municipal powers and private property rights. In November 2009 a prospector named Glenn Griesbach contributes to the latest round of mining claims activity in La Peche. Mr. Griesbach has filed at least 30 claims in La Peche around Duclos. In December 2009 Stelmine Canada Ltd. announced it had purchased mineral rights to a block of 6 and then 80 claims in the Wakefiled area in the hopes of finding rare earth elements.

Montréal, 18 janvier 2010– Réunis aujourd’hui à Montréal, les membres de la coalition Pour que le Québec ait meilleure mine! demandent au gouvernement de se tenir debout face au lobby minier et de se doter d’une politique minière digne de ce nom. Alors que les coffres de l’État sont vides, que le prix de l’or bat des records et que l’industrie minière connaît un autre « boom » de forte croissance qui laisse entrevoir des profits faramineux, le Québec est toujours dépourvu d’une politique minière viable, devant assurer la protection des citoyens et de l’environnement, ainsi que de rapporter à l’État et aux régions des redevances dignes de ce nom. « L’actuel projet de modification de la Loi sur les mines ne changera pratiquement rien à cette situation inacceptable! » dénonce Christian Simard de Nature Québec, qui demande au ministre Simard de tenir une commission publique, la plus large possible, sur cette question. La coalition demande également au ministre d’être « ouvert » et de refaire ses devoirs pour aboutir à une véritable réforme.

Demande de moratoire sur l'uranium non entendue

Face aux risques de contamination radioactive à long terme, près de 90 % de la population de Sept-Iles demande un moratoire sur l'exploration et l'exploitation de mines d'uranium^[1]. Le ministre demeure sourd à cette demande, préférant donner raison à l'industrie, qui minimise et limite son analyse des risques. Pourtant, deux autres ministres canadiens ont déjà résisté au lobby minier et ont imposé des moratoires sur leurs territoires: la Colombie-Britannique et la Nouvelle-Écosse.

Pour Dr Isabelle Gingras, l’une des porte-paroles des médecins de Sept-Iles : « Il importe de faire des choix quant aux minerais que le Québec entend extraire de son sous-sol. Ce choix doit se baser sur nos valeurs communes qui privilégient la protection de la santé et de l’environnement à l’exploitation à tout prix de tout ce que renferme notre sous-sol. Nous ne lâcherons pas tant que Québec n’aura pas entendu raison » avertit-elle.

« Bar ouvert » pour les mégamines à ciel ouvert

Il n’y a rien dans le projet de loi du ministre Simard pour mieux encadrer, voire restreindre, l’exploitation des mégamines à ciel ouvert, tout en encourageant d’autres types d’exploitation minière moins dommageables. Rien non plus pour obliger le remblaiement et la restauration complète de ces fosses une fois l’exploitation terminée. Les cas de la fosse Sigma à Val d’Or et de la future fosse d’Osisko à Malartic, toutes les deux en milieu urbain, sont des exemples notoires de ce grave problème.

Selon Henri Jacob de l’Action Boréale: « C’est un véritable bar ouvert pour les mégatrous à ciel ouvert! Au moins quatre mégatrous sont présentement envisagés en Abitibi. Plusieurs autres pourraient suivre au cours de la prochaine décennie. De nombreux organismes régionaux exigent un débat public sur ce type d'exploitation dont les conséquences sur le territoire et l'environnement sont d'une ampleur encore mal évaluée et marqueront à jamais le paysage de la région et du Québec. Encore là, le gouvernement et la Conférence régionale des élus demeurent sourds! »

Sites miniers abandonnés

Dans la version actuelle du projet de loi, les Québécois devront continuer à payer, seuls, près de 300 millions $ de dettes environnementales, soit le coût pour restaurer les 345 sites miniers abandonnés à travers le Québec. Le gouvernement et l’industrie demeurent muets concernant la recommandation de la coalition de créer un fonds de restauration pour régler ce lourd passif environnemental, financé par une redevance spéciale de 0,5 % sur la valeur brute produite de l’industrie minière pour les 15 prochaines années.

Droits des citoyens non considérés

Le projet de loi ne prévoit pas, dans la majorité des cas, une évaluation environnementale complète pour les nouvelles mines, incluant la possibilité d’audiences publiques par le Bureau d’audiences publiques en environnement (BAPE). Il prévoit plutôt des consultations encadrées par l'industrie elle-même. « Ça soulève de sérieux problèmes d’objectivité, de transparence et d’équité », dénonce Ugo Lapointe, l’un des porte-paroles de la coalition.

Rien non plus pour corriger la situation vécue récemment par des dizaines de citoyens et de familles à Malartic qui se sont vus forcés de vendre ou de déménager leurs maisons avant même que l’évaluation environnementale et les audiences publiques du BAPE n’aient été complétées. Autrement dit, plus d’un an avant que le projet minier n’obtienne les autorisations gouvernementales! L’expérience de Malartic soulève, de l’avis même de la commission du BAPE chargée d’étudier ce projet, « des questions sur le plan éthique et humain ».

Me Nicole Kirouac, personne-ressource au Comité de vigilance de Malartic, rappelle que « La commission du BAPE a pourtant recommandé aux autorités publiques de mettre en place des mécanismes d’encadrement pour éviter ce type de situation à l’avenir et pour s’assurer que les droits de la population soient adéquatement protégés. Malgré ces recommandations, le gouvernement ne semble pas vouloir bouger, ce qui choque profondément les nombreuses familles qui ont souffert d’inéquité et d’injustice à Malartic. Au contraire et, comble d’arrogance, l’actuel projet de Loi sur les minesrenforce les pouvoirs déjà excessifs des entreprises minières en leur permettant explicitement de recourir aux ententes dites de « gré à gré », sans encadrement précis et sans aide prévue pour les citoyens, comme cela s’est produit à Malartic, dénonce Me Kirouac. Cela constitue un grave recul! Le Comité de vigilance de Malartic ne baissera pas les bras sur cette question.»

The map above shows active and pending mining claims in the West Quebec region near Wakefield. The light blue hexes are the pending claims which are numerous. The pace of exploration activity appears to be gaining momentum.

Remember, as a private land owner you may deny consent to an exploration company to come on your property. The Quebec Ministry of Natural Resources and Wildlife (MRNF) has stated on numerous occassions it will respect the wishes of private land owners. Notify the exploration company in writing and copy your registered letter to the MRNF Mines division.

Lots of New Claims in West Quebec

I read an article dated January 10, 2010 in a mining journal about how prospectors and land owners in West Quebec will likely find their interests in conflict once again due to new exploration activity near Wakefield. I could not find in GESTIM exactly which claims are being reference in the article but did discover in West Quebec there are many new claims pending (see map above).

With regards to the article about the six new claims for rare earth elements (REE) I disagree strongly with the author who suggests having face-to-face discussions and having the government force prospectors to repair damage to private property is sufficient to avoid conflict. Those suggestions do not go nearly far enough.

The rights of private property owners need to be protected by law to prevent any and all unwanted exploration on private land.

Below is a link to an interesting article (in French) about the situation in Sept-Îles. Among other things, it discusses the motivations of the doctors who reject uranium exploitation and the engineers/geologists who work for exploration companies and support it.

Highlights include the fact the 24 protesting doctors are not:

politicians seeking re-election
engineers and geologists who live off mining
careerists or self-promoters
ecologists
idealogues

What they are is simply doctors pointing out a health risk - primarily to a drinking water supply.

These same issues apply to MRC des Collines de l'Outaouais and MRC du Pontiac should the pace of uranium exploration revive in future (as some indicators are pointing towards).

In West Quebec the Ottawa, Gatineau and La Peche rivers might all someday be near the site of uranium exploitation. These would be high tonnage, low grade open pit mines with lots of tailings acting like ticking timebombs waiting to seep into the water table and watercourse....

Quebec Government Talking Out of Both Sides of Its Mouth

After repeated statements in the past from various representatives of the Charest government and on the Quebec MRNF's web site that there is "no risk to public health" from uranium exploration, it is surprising how the Quebec Mining Act is going to be amended.

Here is what the MRNF site says:

During uranium exploration, what are the risks to public health?

Uranium exploration does not pose a risk to public health, as recently mentioned by the Direction de santé publique de la Côte-Nord. Uranium exploration methods do not significantly modify the natural environment. Therefore, there is practically no risk of producing an increase in natural public exposure to radioactive substances simply due to mineral exploration.

The new legislation tabled last week in the National Assembly says the following:

47. The Act is amended by inserting the following section after section 230:

“230.1. The holder of a mining right or an operator who is engaged in exploration for or discovers or mines mineral substances that contain or may contain 0.05% or more of uranium must take the protective measures prescribed by regulation and any other measure the Minister may impose.”

I am completely flabergasted by the new law! If there is supposed to be "no risk to public health" from uranium exploration, why then are protective measures needed when even a small amount of uranium is found?

Just What Are the Changes to the Quebec Mining Act?

Last week the Quebec government introduced legislative changes to the Quebec Mining Act.

In short, there are changes to the law about ownership of surface rights, registration of mining rights, how credits for exploration are handled, new powers to the Minister to avoid conflicts with other uses of land (potentially a good thing - Ed.), new mine rehabilitation rules (100% of the rehabilitation costs must be guaranteed), new requirements for public consultation, a requirement to report to the Minister any discovery of uranium of 0.05% or more and some other miscellaneous changes.

So, as noted earlier, some tentative, timid steps forward.

But what's of course missing is a ban on uranium exploration and protection of private land owners' rights! This government just doesn't get it. Then again, maybe they do - from the mining companies.

Doctors resign en masse over uranium exploration

MONTREAL - Twenty doctors have handed in their resignations at the Centre hospitalier régional de Sept-Îles.

In an open letter addressed to Quebec Health Minister Yves Bolduc, the physicians say they have quit, as a group, to protest plans to build an uranium mine on the North Shore.
The protest comes on the heels of the introduction new government mining legislation, which does not impose a moratorium on uranium exploitation in Quebec.

The doctors say they fear for their own families' health as well as for the health of the population in the region.

Nous constatons que l’uranium du Québec, déjà bien connu et claimé, prend une importance mondiale avec l’avenue des pays émergents comme l’Inde qui, pour arriver à une réduction de GES de 45% à Copenhague, convertiront leurs sources d’énergie au nucléaire.

Le Canada, sa technologie et son industrie viennent de signer une entente de partenariat nucléaire avec l’Inde, démontrant que notre uranium et nos entreprises auront un accès privilégié à ce marché (des dizaines de centrales).

Une centrale nucléaire équivaut en dollars au projet de La Romaine. Imaginez
la pression des lobbys.

Quand on pense que pour chaque baril d’uranium sorti du sous-sol québécois, on laissera dans chacune des régions productrices une vingtaine de barils de matières radioactives mélangées aux millions de tonnes de résidus miniers que nous les citoyens du Québec devront en bout de ligne gérer pour toujours.

Le gouvernement de l’Ontario, en octobre 2009, a débloqué 250 millions de dollars pour la gestion des résidus d’une ancienne mine d’uranium. Cela équivaut au budget de restauration de plus de 300 sites miniers abandonnés au Québec. L’uranium n’est pas un métal comme les autres. Il est radioactif et tous les Québécois ont le droit d’être informés et consultés quant à l’avenir d’une industrie de l’uranium au Québec. Entre-temps, il faut un moratoire.

New Mining Claims in La Peche from Indonesia

The most recent newcomer to mining claims in West Quebec is none other than a "natural person" named Glenn Griesbach based in Indonesia. He joins Midland Exploration, SOQUEM (the government of Quebec mineral exploration company) and Wildcat Resources in the latest round of mining claims activity in La Peche.

Mr. Griesbach, alone or along with Kamaleddin Sheikholeslami Salmasi has 926 active mining claims in Quebec. Thirty (30) of those claims, in Mr. G's name only, are in La Peche and were registered November 25, 2009.

An as-yet unknown claims staker(s) has also filed for over 20 new claims to the east of Mr. Griesbach's holdings. The identity of said claims staker(s) will only be revealed if the claims are successfully registered by the MRNF.

We'll see if history repeats itself. This could be another claim flip whereby the new owner sells or options off the claims to an exploration company. If so, it will be none other than the fourth time the claims in the East Aldfield - Duclos - Lac des Loups "triangle" (a.k.a. the Kert Project) have been snapped up in recent years.

Two serious past contenders have abandonned their claims to the Kert Project due to environmental considerations or due to lack of significant mineral findings (not to mention considerable community pressure from 2,500 petition wielding citizens on up to the Mayor opposing uranium exploration).

Ontario Government Moves to Protect Private Property from Mineral Development

In passing new amendments to the Ontario Mining Act on October 21, 2009, Ontario has taken a step to protect private property rights in rural areas from the ravages of mineral exploration and development.

This is an important precedence. The Quebec government should also be supporting the re-unification of surface and sub-surface rights in rural Quebec.

Right now Quebec law says a private landowner can deny consent to exploration on private property, but the law also says the exploration company can seek expropriation. It is the policy of the Quebec government (not the law) to refuse expropriation requests from exploration companies that go against the wishes of the private landowner.

This is a tenuous situation in the minds of many private landowners and requests have been made by WQ-CAMU (and others) to amend the legislation. The Quebec government has so far refused saying it's policy is sufficient.

"Expropriation" (voluntary or otherwise) has been a big factor recently in the development of a new mine in the Malarctic region, where many homes and institutions are being relocated to develop a low grade open pit mine adjacent to a town site (see previous posts).

While only a piece of the puzzle for modernizing mining legislation, re-unification of surface and sub-surface rights would go a long way towards rectifying a significant injustice that has persisted since frontier days.

CBC News - Newfoundland & Labrador - Former N.L. mine toxins endanger town: study

The government of Newfoundland and Labrador is "erring on the side of caution" by suggesting all 800 residents of a town get tested for lead poisoning. Zinc and lead was mined right next to the town and now the tailings are possibly causing health problems.

A $2 million remediation project was shelved when the mining proponent reportedly filed for bankruptcy protection earlier this year. Looks like government (i.e., taxpayers), once again, will have to bail out industry.

There is a local exploration project in La Peche that is seeking lead and zinc. So these developments are of interest to us here.

We'll have to watch how this story in N&L unfolds. Best wishes to the residents of Buchans.

Une coalition demande une large consultation publique

Québec, 23 septembre 2009 – La coalition Pour que le Québec ait meilleure mine! demande qu’une commission parlementaire élargie soit tenue concernant les amendements prévus à la Loi sur les mines du Québec, dont le dépôt à l’Assemblée nationale est envisagé en début novembre. De plus, afin d’aborder des enjeux sociaux et environnementaux qui dépassent largement l’application de la seule Loi sur les mines, la coalition demande au gouvernement de mettre sur pied une commission d’enquête publique sur le secteur minier québécois, du type de la Commission Coulombe et de la Commission Pronovost qui ont été tenues pour les secteurs forestier et agricole. La coalition fait cette intervention le jour même où les autorités du ministère des ressources naturelles comparaissent à la Commission de l’administration publique pour répondre au rapport accablant du Vérificateur général sur la gestion des mines.

Dans une lettre acheminée à la ministre et au ministre délégué aux Ressources naturelles et la Faune (MRNF), madame Nathalie Normandeau et monsieur Serge Simard, la coalition Pour que le Québec ait meilleure mine! a dit accepter l’invitation du ministère « de participer à des consultations préliminaires concernant la réforme prochaine de la Loi sur les mines du Québec », tout en soulignant du même souffle que « les événements récents nous rappellent que les enjeux liés au secteur minier québécois sont beaucoup trop importants pour n’être considérés que dans des consultations préliminaires privées auprès de certains organismes intéressés et choisis ».

Selon Ugo Lapointe du Forum de l’Institut des sciences de l’environnement de l’UQAM « Plusieurs questions doivent être abordées de front pour établir de nouvelles bases, éviter les erreurs du passé et créer un secteur minier dont tous les québécois pourront être fiers, incluant les générations futures ». La coalition se questionne notamment sur les redevances minières qui sont insuffisantes pour compenser la perte de ces ressources non renouvelables, ainsi que sur les sites miniers contaminés et abandonnés, dont la facture officielle frôle les 300 M$ pour les contribuables québécois. Ajoutons à cela les questions de contrôle et de suivi environnemental des projets miniers qui sont nettement inadéquats, celles des droits miniers qui ont préséance sur d’autres types de droits et qui empêchent une gestion intégrée du territoire, ainsi que celles de l’exploitation possible de l’uranium et de plusieurs méga mines à ciel ouvert de type « fort tonnage faible teneur », dont les répercussions sociales et environnementales soulèvent des enjeux éthiques fondamentaux.

Pour Christian Simard de Nature Québec « Les enjeux miniers concernent l’ensemble des québécois. Et, ils doivent avoir accès à toute l’information nécessaire pour encourager leur gouvernement à prendre des décisions éclairées dans ce secteur qui a fait l’objet de vives critiques de la part des citoyens et des organismes sociaux et environnementaux au cours des deux dernières années, notamment suite au rapport du Vérificateur général en avril dernier et au rapport du BAPE pour le projet Osisko ». « S’ajoute à cela les nombreux travaux d’exploration d’uranium qui ont cours un peu partout sur le territoire québécois et qui suscitent l’ire de milliers de citoyens qui réclament un moratoire sur l’exploration de ce métal radioactif au Québec » rajoute François Lapierre du Réseau québécois des groupes écologistes.

La coalition a rencontré, hier, les représentants du MRNF et communiquera prochainement ses préoccupations et ses recommandations préliminaires à la ministre et au public.

Fresh Mining Claims in West Quebec

The map above of a portion of West Quebec from the GESTIM database depicts some fresh mining claims (light blue hexes) that have been filed in the last month.

New claims are in two areas:

1) around the so-called Kert Project between Lac des Loups, East Aldfield and Duclos (an area where both Aldershot Resources and Anglo-Canadian failed to find any significant mineral resources within the last four years);
2) in the area northeast of Fort-Coulonge (where Aldershot Resources abandoned all its claims in the last year).

Existing mining claims are also shown on the map (dark blue hexes) and these have been expiring rapidly as the surge of claims registered in 2007 have run their course without renewals.

Time will tell (it takes the MRNF at least a couple of months to grant claims) who is making these fresh claims.

The peace and quiet was too good to last. Stay tuned.

Quebec Mineral Strategy - Timid Incrementalism Reigns

Well, no surprise really, just a rather flaccid denouement after a very long drawn out wait.

The Quebec Mineral Strategy, originally promised for December 2007, was released today, 18 months late. It contains a number of incremental provisions clearly designed to pander to all while pleasing no one.

The Strategy re-caps how "consultations" were held:

The government held public consultations to develop its Mineral Strategy [in October 2007]. Online consultations looked at the policy directions set out in the consultation paper on Québec’s mineral industry and the five challenges it was facing. The government also held special consultation sessions with industry associations and organizations.

[Note that no "special consultation sessions" were held with municipalities, landowner associations or environmental groups.]

The mining industry is of course front and central - after all it has the powerful lobby and the extensive history of privilege and preferential treatment.

The environment takes a back seat along with property owners and communities. And it almost goes without saying - no moratorium on urnanium exploration and mining in Quebec.

How predictable.

On the economic front, no surprises. Lots of motherhood about fostering investment and creating employment. Nothing wrong with that except we all know now that unfettered capitalism is a cure worse than the illness.

Of course governments in Quebec have long known that capitalism needs to be assisted. That fabled "unseen hand" that Adam Smith wrote about may actually be the not so invisible hand of the State.

And what better time than an economic crisis to justify shelling out new money to an industry already seeing nearly 72% of every dollar invested returned to the investor by the taxpayer [see the earlier post to this blog about the Quebec Auditor General's findings]. How many other investor groups get corporate welfare like that?

Maybe that's why so much effort has been made to help the mining industry with myriad supports and programs, such as:

subsidized geological mapping

taking steps to secure Federal money for "knowledge aquisition projects"

planning infrastructure development to help mining

spending money to promote mining in Quebec to foreign investors [an industry that represents often nothing more than a speculator's gamble or worse]

cherry-picking certain industry funding activities such as the use of chrysotile (shame - they don't even have the nerve to use the word ASBESTOS) and peat (last time we checked peat isn't even a mineral)

promoting the development of the copper mining segment [why that substance?]

placing a special emphasis on financial support for the diamond industry [why diamonds?]

conducting a reassessment of mining royalties [ostensibly to benefit Quebeckers but more likely to pay for the new Heritage Fund - see below]

spending more money on mining R&D

making efforts to secure Federal money for R&D

providing subsidized legal and taxation advice to mineral development companies

expanding SIDEX - an exploration stage investment company in part funded by the Quebec Government

continuing support for SOQUEM the "parapublic" mining exploration firm that "reports to the Societe general de financement" [actually SOQUEM is a 100% Quebec taxpayer-owned mining exploration company that has been operating since the mid-1960s at non-disclosed levels of funding]

more investment in mining-related education

promoting employment and supporting labour markets in the mining sector

creating a new $200 million Mining Heritage Fund for the benefit of the industry for collecting geoscientific data

On the environmental front there is precious little to cheer for. Some effort has been made to promote mine site rehabilitation, further protect the environment and protect the land for the future. By comparison to industry support there is no money in it - no apparent new supports, no "heritage fund."

On the community front a few provisions are made for local and aboriginal participation. No funding has been announced.

So, in summary, the cumulative beneficial changes appear to be:

Requiring a little more from the industry up front for estimated rehabilitation costs [but still apparently not enough to cover the taxpayer funded shortfalls of today]

New rehabilitation guidelines [to be determined]

Environmental impact studies on mines of a certain size [something that we all thought already existed through the BAPE process]

Demanding security for all of the cost of restoring exploration sites [as opposed to only some of the costs - part of the shortfalls of today]

A new exploration guide [not regulations]

Reporting requirements for claims in search of radioactive elements [a tacit admission of the inherent risk of this work]

Regulation of radioactive element exploration [same as above, but real effort to be determined]

A review of bulk sampling applications [surprisingly this wasn't already being done]

A reminder to rehabilitate exploration sites when a claim is filed [really!]

An inventory of eskers with drinking water potential and consideration of possible protection [does this imply that some community water supplies are indeed at risk?]

Setting regional targets for land and resource development and conservation [to be determined]

Holding of community consultations before mining begins [again something we all thought took place already]

Encouraging dialogue between developers and aboriginal communities [!]

Encouraging more aboriginal participation in mining

On request providing local and aboriginal communities with information about regional mining claims [all you have to do is look at GESTIM to get this - oh, right, many of the affected communities don't have high speed Internet in their homes!]

Requiring mining claimants to inform private landowners and tenants that claims have been made affecting their property [it's really hard not to be sarcastic about this one]

Using regional land use plans to reserve or withdraw land from mining claims to reduce disputes [to be determined]

Providing powers to the Minister to refuse claims where deemed to be in the public interest [to be determined]

Clarifying the right of expropriation [to be determined]

All in all, a very timid document indeed with lots left to be determined.

And to make matters worse, the strategy didn't even attempt to legally protect private property like Ontario is moving to do south of the French River.

Nope, exclusive ownership of the "immovable" [i.e., surface rights] is still just a matter of policy.

La Stratégie minérale sera annoncée lundi prochain…
Le Québec est mûr pour une grande réforme du secteur minier

Québec, 25 juin 2009. À quelques jours de la présentation de la première stratégie minérale du Québec qui sera annoncée à Québec lundi, la Coalition Pour que le Québec ait meilleure mine! fait part de ses attentes afin que le secteur minier fasse l’objet d’une réforme en profondeur. L’objectif ne devra pas être ici de créer de la richesse à court terme pour quelques actionnaires et des emplois de courte durée, mais bien de bénéficier à l’ensemble de la société québécoise en minimisant les impacts environnementaux et sociaux inhérents à ce type d’activités.

Pour être crédible, la nouvelle stratégie minérale devra : garantir la restauration complète, aux frais de l’industrie des 345 sites miniers abandonnés que compte le Québec; fixer des redevances minières dignes de ce nom; réformer la loi sur les mines dont les principes datent d’un autre âge; rejeter le développement de mines à lourds impacts comme les mines géantes à ciel ouvert et l’exploitation de l’uranium; et enfin renforcer les contrôles et suivis environnementaux dont l’extrême faiblesse a été dénoncée par le vérificateur général.

Régler une fois pour toutes le passif environnemental des sites miniers abandonnés et s’assurer que plus jamais les contribuables québécois n’hériteront d’une telle facture.

Plus de 264M$ seraient nécessaires pour restaurer et assurer le suivi de 345 sites miniers abandonnés au Québec. Ce n’est pas à la population québécoise d’éponger à elle seule cette dette environnementale et l’industrie doit assumer sa juste part des erreurs du passé. La coalition estime que 1% des revenus bruts de l’industrie suffirait à régler ce problème au cours des 10 prochaines années. Les Québécois ne sont toutefois pas à l’abri de nouveaux sites abandonnés : l’État doit donc exiger 100% de garanties financières payables avant l’ouverture de nouvelles mines pour protéger les générations futures d’un tel fardeau.

Plus de passe-droit sur les redevances minières.
Comme le font la plupart des pays et régions minières, l’État québécois devrait exiger des redevances minimales sur la valeur brute produite du sous-sol québécois (et non seulement sur les profits des entreprises qui bénéficient de multiples évasions fiscales possibles). La coalition s’attend également à ce qu’une part importante des redevances soient partagées avec les régions et les communautés touchées, de sorte qu’elles puissent dès maintenant investir une partie de ces fonds pour préparer l’avenir, diversifier leurs économies et mieux faire face à « l’après minier » et à l’inévitable épuisement des ressources minières non renouvelables.

Réformer la désuète Loi sur les mines du Québec
La Loi sur les mines du Québec, dont les principes fondateurs datent d’un autre âge, doit faire l’objet d’une réforme en profondeur de sorte que le développement minier n’ait plus préséance sur toute autre utilisation du territoire et qu’une véritable démocratie consultative soit instaurée à tous les stades du cycle minier (exploration, exploitation, fermeture et restauration des sites). Il faut resituer le droit des citoyens, des collectivités et des régions au cœur d’une nouvelle loi sur les mines et s’assurer que les propriétaires privés, les municipalités, les communautés autochtones et l’ensemble des utilisateurs du territoire soient adéquatement informés et consultés.

Non au développement minier à forts impacts écologiques
Une nouvelle stratégie minérale doit imposer des balises claires aux types de développement minier souhaités et non souhaités aux plans environnemental et social. De part leur intensité environnementale et leurs conséquences sur la société et les écosystèmes, la coalition juge que les mines d’uranium et les méga mines en surface de type « fort tonnage faible teneur » sont inacceptables. Des alternatives existent et doivent être privilégiées en concertation avec le milieu environnemental.

Renforcer le contrôle et le suivi environnemental
Le Vérificateur général critiquait vertement le manque de contrôle environnemental des projets miniers au Québec. La nouvelle stratégie minérale doit s’attaquer de front à cette problématique en allouant davantage de ressources aux MRNF et au MDDEP. La création et le financement adéquat de comités de vigilance regroupant des citoyens et des experts du milieu environnemental permettraient également de renforcer le contrôle environnemental des projets miniers sur le territoire.

Enfin, la Coalition Pour que le Québec ait meilleure mine ne voit pas d’un très bon œil qu’une si importante stratégie soit annoncée en pleine saison estivale, plus de 18 mois après le dépôt d’une ébauche de document, ébauche qui avait fait l’objet d’une plus que discrète consultation éclair à l’automne 2007.

Quebec's Auditor General Agrees - Mining Companies Short Change Taxpayers

Further to my recent post on how one exploration company active in Quebec and BC last year walked away with $600K in taxpayer money, Quebec's Auditor General confirmed last April a number of facts about the impact of the mining industry in Quebec.

Some astonishing information:

between 2002 and 2008, 14 of the 24 mining companies operating in Quebec paid zero royalties (in the same period, the annual output of Quebec’s mining sector was $4.2 billion)
during that timeframe an average of 1.5 per cent of the gross value of Quebec’s mines was paid in royalties
the industry paid $109 million for environmental remediation, while the actual costs of cleaning up abandoned mine sites was $352 million, leaving Quebec to pick up 69 per cent of the tab, or $243 million
file reviews by the Auditor General revealed no trace of collaboration between the department of natural resources and wildlife and the department of sustainable development, environment and parks
the objective of the Quebec government's encouragement and financial subsidies to the mining industry is job creation yet the employment in Quebec’s mining sector actually dropped by 17 per cent in the last 10 years
Quebec is a "bonanza for investors" who get back in tax credits $716 for every $1,000 they invest in a mining company
Quebec mines do not respect the three elements of sustainable development: projects must be economically sound, environmentally and socially acceptable to those living nearby

In the National Assembly, junior minister Simard said the Charest government would introduce “very soon” a new mining strategy with three priorities: wealth creation, respect for the environment and developing mines with the local population.

This is the same mineral strategy that was announced but not delivered back in October 2007. Reportedly it is being released on Monday, June 29, 2009 and will be followed by "consultations" this summer and new legislation in the fall.

We'll see.

Asked for its reaction to the auditor general’s findings by the Montreal Gazette, the Mining Association of Canada did not return phone calls.

Given the circumstances and the general stresses in the Quebec economy, why should, I ask again, taxpayers be subsidizing investors in this sector? What is the "return on investment"? If jobs are being lost and companies are dumping the majority of their remediation costs back onto the average citizen while taking profits out of the province (in many cases) who is protecting the Quebec citizen?

The long overdue Mineral Strategy has a lot to answer for.

Aldershot Pockets Nearly $600K in Tax Credits from Quebec and British Columbia Taxpayers

Aldershot, a formerly active junior exploration company operating in West Quebec, has again confirmed its retreat from the region in its recently published annual financial statements.

The activity in the year ending January 31, 2009 for Quebec was described as follows:

During the year, it became clear that the Company would not be able to raise sufficient funding to continue with its plans for exploring its many claims in the province. Consequently management devoted considerable time to negotiating with the optionees for the respective claims to be returned to them in a cash neutral manner for the Company. At the completion of this exercise, management wrote off resource properties’ acquisition costs which total $2,228,882.

The company asserts in its financial report for the last fiscal year the following:

The Company has incurred losses since inception and as at January 31, 2009, the Company had an accumulated deficit of $17,202,965. The ability of the Company to continue as a going concern is in substantial doubt and is dependent upon the continued support from its directors, the ability to continue to raise adequate financing or achieving profitable operations in the future, the outcome of which cannot be predicted at this time.

Isn't it unforunate that the very same company that has consumed over $17M in investor resources (since inception) has also in its last fiscal year recieved nearly $600K in taxpayer-funded tax credits?

The Company received exploration tax credits of $598,811 relating to its Quebec and British Columbia properties during the year ended January 31, 2009.... The Company reported working capital of $131,335 at January 31, 2009...

Doing the math, the company has received nearly five times as much money in taxpayer credits than it currently has in working capital. Without our help, it would appear the lifeline would be gone.

Questions "du jour":

Is self-described highly speculative business something we taxpayers should subsidize - especially given looming budget deficits and the recession's hit on personal balance sheets?
Why are we taxpayers obliged to finance large sums for our governments to give exploration companies so they in turn can infringe on our property rights?

Montreal Protest Makes the Point

Protestors, including representation from Quebec's Malarctic region (the site of a proposed large open pit mine), yesterday staked a symbolic mining claim on Montreal's famed Mount Royal. The cultural and geographic landmark was the site of a protest against open pit mining and the unaccountable acts of some mining companies worldwide. The artist's renditions above show the before and after view of the mine site in downtown Montreal.

On Friday, the Quebec government department responsible for mines [apparently quite concerned] declared Mount Royal a protected zone that is off-limits to surveyors.

More Evidence of a Mining Stock Market Resurgence

Little by little anecdotal evidence is accumulating that the mining sector is starting to come back to life - this is possibly the beginning of the next exploration cycle.

Aldershot Resources just announced a private placement financing of up to $180,000. Pinetree Capital previously announced it had accumulated shares in ALZ bringing its holdings above 10%.

Hawk Uranium just announced, without reference to NI 43-101, preliminary results for its Holdsworth Gold Project.

Out of 30 mining stocks we track, only 4 were down yesterday, 4 were neutral, and 22 were up - Aldershot was up by 25% and Hawk Uranium was up by 20%.

Deja vu.

Industry Chatter on the Price of Uranium - Foreshadowing Another Wave of Exploration?

Spot prices for uranium recently went up to $44 from $42 according to UxC. This is at least the second monthly price increase in the heavy metal, which was about $40 dollars not long ago (a far cry from its 2007 peak of over $130).

Industry chatter from several sources including Globe and Mail blogger Steve Ladurantaye suggests the bottom for uranium prices has been reached. "Distressed financial selling" is reportedly over.

Some analysts are saying the "nuclear renaissance" is back [not that it was ever really here before - Ed.] and countries like China, India and Brazil are starting to build up their inventories of uranium.

Some analysts are also predicting Cameco, with reportedly about $700M in the bank, is considering the acquisition of a $1B to $2B uranium mining company.

Others, like the National Post yesterday (see link below), are reporting Cameco is quite active in the uranium spot market. In another report, one analyst said the pattern of recent sales at successively higher prices indicates a market bottom may have been hit. [Hmmm, this spot market is very thinly traded and Cameco is one of the biggest players - is it possible Cameco is affecting spot market prices by its buying activity? - Ed.].

Sounds a bit bullish but then it could be standard industry hype. And hype is pretty much the lifeblood of most exploration company speculators (financial and geological) and speculators are absolutely desperate for any opportunity to mine market upside.

Many of the junior exploration companies, hovered over by their severely burned financial backers, are hanging on by a thread with little more than $100K or $200K left in their bank accounts (or less). Recent trends in these often tiny one or two person companies include beating their suppliers into submission and forcing them to take worthless shares in place of cash payments for services rendered.

More significantly in the context of my working hypothesis, several junior companies have recently re-priced the exercise price of a huge inventory of existing stock options and warrants dramatically downwards, meaning that basically worthless options/warrants could become worth something once again if stock prices started to climb. If that doesn't create momentum what on earth will?

Any prospect of a price increase in the base metal itself (aka. in the fundamentals) provides the opportunity for a surge in exploration company stock prices, making it possible for these juniors to rake in another round of susceptible investor money.

Keep you eye on insider trading reports. If you see an increase in the number of insiders buying shares in the uranium sector, that is another signal the next round of "pump and dump" is on its way.*

Of course about a year ago similar "analysis" was predicting a bottom to the price of uranium - but that prediction was was premature. Caveat emptor.

Nevertheless, sometimes chatter builds momentum and when the financial bulls run the mining exploration companies are soon to follow.

Are we heading towards another round of frenzied claims and exploration activity?

*"Pump and dump" refers to the tried and true practice of insiders receiving stock options or making stock purchases while company stock prices are rock bottom and then hyping up the company's prospects to gullible investors that buy in at increasingly higher stock prices. Eventually with inflated prices prevailing the original insiders are able to liquidate their positions at potentially huge profit.

Ontario Makes Small Moves to Change Mining Legislation

A long awaited upgrade to Ontario's 100+ year old mining legislation was introduced in the legislature on April 30, 2009. It is receiving mixed reviews from private land owners, aboriginal people and the mining industry.

One noteworthy change is that private property owners south of the French River who do not own subsurface rights, and where those subsurface rights have not already been claimed, will now have protection against future claims. The Province has decided to remove those unclaimed mineral rights from lands available for exploration.

This is something the Province of Quebec needs to do and something we and many others have been requesting for at least two years now. Quebec has the chance to make positive changes to the mining regime when it releases its long overdue Mineral Strategy (reportedly in the next two or three weeks). Stayed tuned.

Court Victory Forces Canada to Report Pollution Data for Mines

TORONTO - Great Lakes United, Mining Watch Canada and Ecojustice are hailing a landmark decision from the Federal Court of Canada released late yesterday that will force the federal government to stop withholding data on one of Canada's largest sources of pollution -- millions of tonnes of toxic mine tailings and waste rock from mining operations throughout the country.

The Federal Court sided with the groups and issued an Order demanding that the federal government immediately begin publicly reporting mining pollution data from 2006 onward to the National Pollutant Release Inventory (NPRI). The strongly worded decision describes the government's pace as "glacial" and chastises the government for turning a "blind eye"to the issue and dragging its feet for "more than 16 years".

"This is a huge decision for environmental justice in Canada," said Ecojustice lawyer Justin Duncan. Fellow lawyer Marlene Cashin added,"The court has unequivocally upheld the right of Canadians to know when the health of their communities and the environment is under threat from one of the country's largest sources of toxic pollution."

The lawsuit was filed in Federal Court in 2007 on behalf of MiningWatch Canada and Great Lakes United by Ecojustice (formerly Sierra Legal Defence Fund). The lawsuit alleged that the Minister of Environment broke the law when he failed to collect and report this pollution information from mines in Canada under the NPRI.

"This is a victory that should be celebrated from Smithers to Voisey'sBay," said MiningWatch Canada spokesman Jamie Kneen. "The public has a right to know what kind of toxic liabilities are being created every day. It's always been bizarre to us that the mining industry should not face the same reporting requirements as every other industrial sector, and we're pleased that the Court agreed with us."

In stark contrast, since 1998, the U.S. government has required mining companies to report all pollutants under the American equivalent of the NPRI, the Toxics Release Inventory (TRI). In 2005, the 72 mines reporting to the TRI released more than 500 million kilograms of mine tailings and waste rock -- accounting for 27% of all U.S. pollutants reported. With yesterday's court decision, pollution data from Canada's 80 metal mining facilities will now similarly have to be reported under the NPRI.

"Canadians living in places like Sudbury, with mining operations in their backyards, were blindfolded while millions of kilograms of carcinogens and heavy metals accumulated in tailings ponds and waste rock piles across the country," said John Jackson of Great Lakes United. "With this decision,the blindfold comes off and citizens can truly hold these companies to account for their pollution and the environmental and health dangers they pose."

Méga mine à ciel ouvert en Abitibi-Témiscamingue

Une coalition demande au Bape de ne pas approuver le projet Osisko

Malartic, le 15 avril 2009. Le Bureau d’audiences publiques en environnement (BAPE) ne devrait pas approuver le projet de mine d’or géante à ciel ouvert à Malartic en Abitibi-Témiscamingue et devrait recommander des dédommagements pour les citoyens qui ont été touchés par le déménagement de près du quart de leur municipalité, réalisé avant l’examen et l’approbation du projet. Selon la coalition Pour que le Québec ait meilleure mine!, qui présentait son mémoire à Malartic, l’approbation de ce projet constituerait un dangereux précédent pour la région et le Québec qui n’ont pas d’expérience dans l’exploitation de ce type de mine lequel vise l’extraction à grande échelle et à ciel ouvert de très grandes quantités de roche pour très peu de métal produit. La fosse projetée, en plein cœur de Malartic, aurait 2 kilomètres de long, 780 mètres de large et une profondeur de près de 400 mètres.

Des enjeux environnementaux

Pour Henri Jacob, de l’Action boréale Abitibi-Témiscamingue, «Les méga mines à ciel ouvert sont comparables aux coupes à blanc excessives du secteur forestier ou aux sables bitumineux de l’industrie du pétrole, et n’ont rien à voir avec la révolution verte dont l’industrie minière a réellement besoin!».

Selon Ugo Lapointe du Forum de l’Institut des sciences de l’environnement de l’UQAM (ISE), « Ouvrir grande la porte aux mines à ciel ouvert d’envergure pour les métaux précieux et usuels contribuerait à intensifier la pression environnementale de l’exploitation minière comparativement aux mines souterraines conventionnelles: c’est plus d’énergie, plus de produits chimiques, plus de résidus miniers et plus d’eau par unité de métal produit, pour moins de bénéfices à long terme. Les entreprises y trouvent leur profit en faisant des économies d’échelle et en accélérant la cadence de production ».

La compagnie Osisko souhaite exploiter cette mine d’or de type « fort tonnage faible teneur » pour une période de 9 ans seulement, soit en soutirant près de 525 millions de tonnes de roche ayant une faible teneur d’or récupérable. En fin de projet, l’or total produit aura un volume à peine supérieur à celui occupé par une petite voiture. Chaque jour, 25 millions de litres d’eau (deux fois la consommation quotidienne de la ville de Rouyn-Noranda), 11 tonnes de cyanure et 30 autres tonnes de produits chimiques variés seront nécessaires, en plus de quantités importantes d’énergie et de carburants. Une fois les opérations terminées, ce sont près de 800 hectares de territoire affectés, dont une montagne de roches stériles de 100 m de haut, un réservoir endigué de 2 km de long, ainsi qu’une plaine de résidus miniers s’étendant sur près de 2,5 km qui seront légués aux générations futures. Le principal scénario de restauration de la fosse envisagé pour le moment est de l’ennoyer en y pompant de l’eau pendant 24 ans. Les différents intervenants aux audiences publiques semblent croire qu’il ne sera pas possible de créer un lac vivant avec cette fosse.

« Ce type d’exploitation minière ressemble davantage à du pillage de ressources qu'à un véritable développement fait pour les gens », selon Christian Simard, de Nature Québec. « On parle souvent de malbouffe, mais au Québec, on fait souvent du mal développement. Il faut changer cela et traiter notre territoire et ses ressources de façon plus durable », croit Christian Simard.

Des alternatives existent

Selon Ugo Lapointe « Ouvrir grande la porte à ce type d’exploitation minière, présent dans l’hémisphère sud, constitueait un sérieux préjudice à un développement plus responsable voir durable du secteur minier, d’autant plus qu’il existe des alternatives à l’exploitation et la production de métaux précieux et usuels (or, argent, cuivre, zinc, nickel, etc.) ». Dans une lettre soumise aux élus et aux leaders de la région en novembre 2008, la Coalition proposait de faire de l’Abitibi-Témiscamingue un pôle d’excellence au niveau international pour le développement de mines de métaux précieux et usuels ayant un minimum d’impacts sur l’environnement et la santé pour un maximum de retombées pour les communautés. Parmi les propositions avancées, la Coalition recommandait de favoriser le développement minier en profondeur plutôt qu’en surface.

L’Abitbi-Témiscamingue compte déjà, dans son histoire, une centaine de mines de métaux précieux et usuels, dont la très grande majorité sont souterraines. Jusqu’à tout récemment, plusieurs intervenants du secteur minier s’entendaient pour dire que l’exploitation souterraine en profondeur constituait l’avenir minier en région. Qu’il y avait un avantage à développer cette expertise dès maintenant afin de pouvoir non seulement trouver et exploiter de nouveaux gisements, mais également développer et exporter notre savoir-faire à l’échelle internationale. Les mines La Ronde et Lapa, à une trentaine de kilomètres à l’ouest de Malartic, en sont de bons exemples.

Dans son mémoire, disponible sur le site Internet de Nature Québec (http://www.naturequebec.org/ressources/fichiers/Energie_climat/ME09-04-15_Osisko_coalition.pdf), la Coalition a attiré l’attention du BAPE sur le fait qu’il y a actuellement trois autres projets de mines à ciel ouvert de type « fort tonnage faible teneur » en préparation en Abitibi-Témiscamingue. Il importe donc de ne pas créer de précédents en approuvant ces projets à la pièce, projets qui modifieraient en profondeur le paysage minier (et le paysage tout court) de l’Abitibi-Témiscamingue. Pour faire de bons choix stratégiques dans le domaine des mines, Pour que le Québec ait meilleure mine ! recommande la tenue d’un large débat public, qui pourrait être tenu sous l’égide d’une commission indépendante.

Coalition Hard at Work to Raise Awareness About the Perils of Open Pit Mining in Quebec

The coalition Pour que le Québec ait meilleure mine ! is very busy these days. It's been engaged in the Bureau d’audience publique en environnement (BAPE) convened for the proposed open pit mine Osisko wishes to develop in Abitibi.

Some of the concerns the Coalition highlights:

impacts on underground water supplies
health and safety impacts of dynamite use on the edge of a town site
quality of life concerns for dozens of citizens being relocated to make room for the mine site
the likelihood that taxpayers will have to pay for mine site restoration costs.

Event: Canadian Mining Abuses Abroad and at Home

The Ottawa Coalition Against Mining Uruanium and the Ottawa Public Library are co-sponsoring an event called: CANADIAN MINING ABUSES ABROAD AND AT HOME.

The event features:

ALAIN DENEAULT author of "Noir Canada - Pillage, Corruption and Criminality in Africa" who will speak about the Canadian mining industry in Africa.
CHARLES FICNER and DAVID GILL from the Coalition for BALANCED Mining Act Reform who will speak on the topic: "Is Ontario the Liberia of Mining?"

The event takes place TUESDAY, MAY 19, 2009 at the Ottawa Public Library auditorium (120 Metcalfe Street) - 6:30 PM TO 9:00 PM.
